No Charges in Shooting of Shoplifter?

A Black man, Zhadius Penn, was shot and killed by a security guard at the Ralph’s supermarket in downtown San Diego on the night of February 12th, 2021.  According to news reports, the circumstances were as follows:

Mr. Penn was confronted by the guard on suspicion of attempting to shoplift a bottle of alcohol.  Mr. Penn threw the bottle of alcohol at the guard, cutting the guard’s head, and then fled the store.  The guard used his gun to shoot at Penn, who by that time was outside the supermarket.  Mr. Penn was hit and pronounced dead at the hospital.

According to these same news reports, the San Diego County DA is not going to prosecute the security guard, because the guard was acting in self-defense.

We are left with the following questions:

  • How is killing a man who is running away “self-defense”?
  • Did the guard chase Mr. Penn before shooting him?  How would that be self-defense?
  • How safe is it to shoot through an open doorway, with limited visibility, into the darkness?  Had Mr. Penn not been struck, who else might have been killed?
  • Would Mr. Penn be alive today if he had been white?
  • Would charges have been filed against the security guard if Mr. Penn had been white?
  • Was the security guard an off-duty member of the law enforcement community?
  • What company employs the guard, and what are their policies and procedures?  Will he face any sanctions from the company?
  • If the security guard is a police officer, will he face any sanctions from the law enforcement agency which employs him?
  • Where is Ralph’s in all this?  Do they approve of what has been done?  Will they be pushing for change?

 

 

What we see is a Black man executed for suspicion of shoplifting.  Not, this time, by a sworn officer acting in the line of duty, but by an employee of a grocery store.  At what point will we see the District Attorney start protecting our lives by prosecuting the perpetrators of unnecessary gun violence?

Dear Ms Winkley and Ms Schroeder,

We are writing to thank you for the article in Sunday’s Union-Tribune regarding bias in policing in the San Diego Police Department and the San Diego County Sheriff’s Department(1).  You raise an important issue and make many good points.

We at the NAACP San Diego Branch recognize that policing is a difficult job.  We know it is made more difficult by the nearly complete refusal of our society to address the legitimate problems of the poor and the non-white, and to instead use policing to suppress their reactions to injustice.  

We understand that criticisms of policing, however carefully researched and phrased, naturally result in defensiveness and resistance on the part of many in the policing community.  We recognize that most in the policing community honestly want to improve the outcomes for all our residents, including residents of color.

And yet, study after study, yours included, shows that disparate outcomes remain.  Far more African-Americans are arrested than their share of the population.  Far more African-Americans wash out of our Police (and Fire) applications and training processes than their share of applicants.  We also know from recent studies and events that there are a significant number of avowed white supremacists  in our public safety organizations.

Unfortunately, decades of court decisions have eroded the remedies available to such disparities, leaving us in a situation where the only way to get a judicial remedy is for an officer to have conscious race hatred and be foolish enough to express it openly.  Amazingly, even this does continue to occur.

Looming over all this is the specter of violence.  Recruits fresh out of the academy are put on the street, armed with deadly weapons and nearly no possibility of judicial accountability for those they may injure or kill.  They have been taught that every situation is potentially lethal.  They have been taught that anything less than instant compliance on the part of civilians is a form of violent aggression.  It is hardly a wonder that terrified officers shoot terrified civilians, in what is a tragedy for both.  It is hardly a wonder that so many of these uncalled-for shootings involve Black and brown folks, given the biases that make them so much more likely to be stopped, and so much more likely to be considered dangerous when stopped.

It is long past time to study.  It is long past time to prove, again and again and again, that bias is an issue in policing and our society.  We cannot count on the courts to act, especially with the radical makeup of the current Supreme Court.  The problem of bias must be solved locally.

That is why we call on Mayor Todd Gloria and the San Diego City Council to act boldly.  That is why we call on Sheriff Gore and the San Diego County Board of Supervisors to act boldly.  That is why we call on San Diego County District Attorney Summer Stephan to  act boldly.  There is much that they can do to start fixing this problem.  We would be delighted to explain in detail what they can do, now, to make progress toward “justice for all.”  Our list would start with swift and thorough training in de-escalation, include ongoing wellness checks for all officers, and swift progress with the Mobile Crisis Response Teams; it would not end there.

We welcome engagement with the San Diego Police Department, as well as all the other law enforcement agencies in San Diego.

Under direction of the Director of Audit, Risk Management & Safety, plans, coordinates and participates in administering a comprehensive District-wide insurance and risk management program, including workers’ compensation; identifies and measures all exposures to accidental risks; assesses and recommends appropriate action to senior management; supervises recovery of costs for property damage to District property; recommends risk financing alternatives; manages large deductible programs and collateral in risk financing programs, participates in insurance pooling and performs related duties as assigned

DISTINGUISHING CHARACTERISTICS

Risk Management Administrator is responsible for performing a variety of complex and specialized duties in managing and administering the District’s insurance and risk management program.  The incumbent assesses exposure to risk and adverse consequences for Port operations, financial position or community reputation and recommends action through indemnification or insurance to minimize or mitigate exposure.  The incumbent negotiates and administers a wide variety of insurance coverage and is expected to work independently and exercise sound professional judgment and discretion in dealing with all interested parties in the resolution of cases, analysis of District risk exposure and management of District insurance policies.

Risk Management Administrator is distinguished from Risk Management Analyst in that an incumbent in the former class performs analysis of more complex claims, having greater potential financial and public impact, and work of greater complexity and responsibility, requiring the exercise of greater risk management expertise and independent judgment in a greater variety of situations on a frequent basis. ESSENTIAL DUTIES AND RESPONSIBILITIES:The following statements are intended to describe the general nature and level of work performed by people assigned to this classification.  They are not intended to be an exhaustive list of all responsibilities, duties and skills required of personnel so classified.

1. Manages the District’s insurance programs including the purchase of new insurance policies and renewal of existing policies; administers insurance brokers’ service agreements and monitors transparency of insurance brokers’ fees.  May select and direct activities of actuarial, property appraisal services, external safety, engineering and loss prevention experts.  Collaborates with other public entities on District’s interest in property and insurance programs.

2. Identifies, researches, analyzes and evaluates potential risk or loss exposure for current and potential future activities and operations; considers and recommends new/enhanced insurance coverage and self-insured retention where appropriate; monitors costs where self-insured retentions exist; works with the Financial Services Department/Treasurer’s Office in allocating insurance premium costs to appropriate projects/internal orders in securing collateral for risk financing mechanisms and in forecasting insurance premium costs and long term liabilities from open claims.

3. Oversees administration of the Port’s workers’ compensation program, including claims management, monitoring of claim costs, quarterly claim review and attending Workers’ Compensation Appeals Board hearings to authorize claim settlements, represent the Port’s interest and to evaluate and recommend carriers/programs for insurance contract renewal.  Coordinates interaction with Safety to implement loss prevention and loss control activities before and after workers’ compensation claims; coordinates insurance carrier loss control activities with Safety.

4. Supervises and directs administration of insurance requirements in contracts and obtain proof of insurance from District lessees, tenants, permitees, contractors and consultants; confers with insurance brokers and agents to assist in obtaining proper proof of insurance; advises appropriate departments if District lessees, tenants, permitees, contractors or consultants are in default by not providing adequate proof of insurance. Performs contract review for other departments during formation of contracts and agreements.  Supervises maintenance of historical proofs of insurance to assist Port Attorney in tendering claims and lawsuits to the appropriate responsible party.

5. Supervises and directs recovery of costs for damage to District property; coordinates claims management activities with appropriate parties; submits claims to District insurance carriers for direct damage to District property, including conducting site visits with insurance adjusters; supervises monitoring of litigated claims; supervises the maintenance and update of the claims database for claims against the District; collaborates on claims reporting procedures and other related claim matters with Port Attorney, insurance brokers and other affected departments; activates the appropriate retention or transfer technique when a loss occurs.

6. Provides advice and assistance to other District departments on insurance and risk exposure issues.

7. Responds to inquiries and requests for information from other public agencies regarding the District’s risk management techniques and practices.

8. Plans, organizes, directs and evaluates the performance of assigned staff.

9. Interprets policies, rules and regulations regarding insurance and public liability as it relates to District Risk Management Program.

OTHER DUTIES

1. Stays abreast of risk management and insurance industry practices, developments and trends through participation in insurance/risk management organizations.

2. Participates in the California Association of Port Authorities – Insurance and Risk Management Committee to facilitate the joint purchase of excess liability and
interface with the committee’s insurance brokers.

3. Participates on special projects and appropriate cross-department committees, as assigned. QUALIFICATIONS:Knowledge of:

1. Practices, procedures and standards applicable to management, administration, analysis, adjudication, resolution, settlement and litigation of liability claims and workers’ compensation claims.

2. Owner Controlled Insurance Program principles and practices, trends and developments, policies and procedures.

3. Risk management and risk mitigation/financing principles and procedures.

4. Insurance statutes, regulations and practices, general lines of insurance, insurance underwriting practices, insurance contract language.

5. Principles and practices of insurance underwriting, safety, security and other loss prevention methods.

6. Property, casualty and liability insurance industry trends and practices.

7. Federal and state law governing municipal government liability, including Tort Claims Act governing public bodies, Unfair Claims Practices Act and California comparative negligence laws.

8. Federal, state and local laws and regulations governing the administration of workers’ compensation and maintenance of employee records.

9. Port requirements and procedures for the acceptance, settlement and payment of general liability claims.

10. Office practices and procedures commonly used in managing and administering claims and claim files.

11. Methods of identifying exposure to loss and investigating and correcting industrial and environmental hazards.

12. Principles and practices of public administration, including purchasing, contracting and maintenance of public records.

13. Methods and techniques for conducting statistical and financial analyses.

14. Financial management principles and practices applicable to areas of assigned responsibility.

15. Principles and practices of sound business communication.

Ability to:

1. Operate a computer using word processing and other business software.

2. Represent the Port authoritatively in negotiations with insurers and claimants.

3. Analyze complex liability claims involving difficult, non-standard issues and problems, identify third party liability, evaluate alternatives and make appropriate recommendations, including opportunities to mitigate liability and damages.

4. Analyze, classify and rate risks, exposure and loss expectancies.

5. Interpret insurance contract language and analyze insurance policy provisions.

6. Conduct research of loss prevention and control issues, evaluate alternatives and reach sound conclusions and recommendations for improvement.

7. Exercise sound independent judgment within established guidelines.

8. Understand, interpret and explain and apply complex rules, regulation, policies and procedures.

9. Prepare clear, concise and accurate reports and correspondence.

10. Organize and maintain office and specialized claims files.

11. Communicate clearly and effectively, orally and in writing.

12. Handle sensitive situations with compassion, tact and confidentiality; maintain confidential information.

13. Establish and maintain effective working relationships with District staff and legal counsel, insurance brokers and others encountered in the course of the work.

MINIMUM REQUIREMENTS

Education, Training and Experience:

Graduation from a four-year college or university with major course work in finance, business, public administration or a closely related field; and at least four years of progressively responsible risk management and insurance experience or graduation from high school or GED equivalent, and at least seven years of progressively responsible risk management and insurance experience.  Experience in a public agency is preferred. Time served as a District Intern counts towards the years of experience.

Licenses; Certificates; Special Requirements:

A current, valid California Class C driver’s license at time of appointment and maintained at all times thereafter in order to operate a vehicle on District business.

Strong brings 15 years of experience in local government leadership and community engagement to the role, intended to identify systemic bias within the county government.

Strong spent nine years in the U.S. Navy as a hospital corpsman before settling in San Diego. He joined the county in the human resources department and was promoted into key leadership positions, including chief of staff of the Chief Administrative Office, which implements the policy directives of the board and manages the day-to-day operations of the county.

Kelly O. Elmore, MD, is a board-certified OB/GYN, health care executive and chief wellness officer for clients across the globe. While Dr. Elmore considers her practice, Viva Life Health Hub in San Diego, as her home, she travels the world and sees most of her private medical concierge patients virtually. 

After graduating summa cum laude with a Bachelor’s of Science from Xavier University of Louisiana in New Orleans, Dr. Elmore completed her medical degree at The University of Chicago Pritzker School of Medicine in Chicago on a full scholarship and residency in San Diego, California. Time to Fulfill the Promise of Progress

Dear Mayor Gloria,

We have previously written to you (https://www.sandiegonaacp.org/2021/03/15/stockton-economic-empowerment-demonstration/) about SEED, the Stockton Economic Empowerment Demonstration, which gave a consistent $500.00 a month to bring people out of poverty with a guaranteed monthly income. Supporters said it would give people the much-needed financial security to find good jobs and avoid debt.  Analysts found that it worked.

President Biden’s American Rescue Plan contains an experiment in basic income (https://www.vox.com/policy-and-politics/22319572/joe-biden-american-rescue-plan-war-on-poverty).

Now Oakland has launched a basic income program (https://www.bet.com/news/national/2021/03/24/oakland-launches-program-low-income-families-of-color-500-month.html).

Mr. Mayor, you know that basic income helps poor families, by providing them a little bit of security to go to school, to look for a better job, to weather the minor storms that more affluent people can shrug off.

We’re again asking that you join with other Mayors in our state for a guaranteed income.  There is a proposal in the California legislature for $1,000 dollars per month for three years for those in the program.  We are still looking forward to seeing you implement a program of your own.

Your first 100 days are over.  What are the next 100 days going to bring?  Will you advance a proposal for basic income?

When will the lives of Africans and African-Americans, who reside in every District of the City, actually start to change as a result of your leadership?  Bold leadership means bold action.  We want to see that begin to happen.

Black-Owned and Operated Coffee Shop Repeatedly Vandalized in Lemon Grove

To City Manager Lydia Romero,

We, the NAACP San Diego Branch, need to know what steps have been taken in regards to upswing in vandalism and what has the city done to increase patrol or discuss surveillance equipment on the main street? 

On March 14, 2021, the exterior windows of The Hamlett Coffee Shop located at 7801 Broadway were smashed at 12:27am, Saturday morning and they are trying to find out who is responsible.

This is the second time within a 6-week period that The Hamlett Coffee Shop has been attacked. The first incident occurred on February 5th, when three windows were purposefully shattered, leaving the business exposed and vulnerable to further damage.

The Hamlett Coffee Shop was originally slated to open its doors to serve the Lemon Grove community on January 1st, 2021, but postponed its opening due to the reinstatement of the COVID-19 Stay-At-Home order. These recent acts of violence compounded with the impacts of COVID-19 have continued to push the business’ grand opening date and have created a great financial strain on the business and family. 

We also need the captain of the Sheriff’s substation to respond with the policy and procedures as to when vandalism of over two Black businesses, with one having a message left behind, gets classified as a hate crime?
